Wait, are prediction markets actually just federally regulated swaps now?

Hey everyone, I’ve been trying to wrap my head around this whole mess with prediction markets and the CFTC, and I'm honestly super confused. Ngl, seeing all these sports and political event contracts blowing up with billions in volume got me curious, but this new rule stuff is making my head spin.

From what I gather, the CFTC just dropped a bombshell saying these peer-to-peer event contracts are basically commodity swaps under their turf, while traditional sportsbooks are still state gaming. But then you’ve got federal courts totally split—like the Third Circuit and Ninth Circuit arguing over whether states can just ban the whole thing anyway. If New Jersey actually takes this to the Supreme Court, are we looking at a total wipeout for prediction exchanges, or is federal law gonna override everything?

I’m just a retail trader trying to figure out if I can keep using these platforms without waking up to find them geofenced or shut down in my state. For the guys who've been trading event contracts or following derivatives regulation for a while, how is this actually going to impact market liquidity? Should I hold off on trading these, or is this just standard FUD before things clear up? Would love to hear how you're playing this.
